The Legislative Report(Monday, March 1, 2010) John Kerry Requests Amendment to the ConstitutionIn early February, John Kerry announced his support for a constitutional amendment that would restrict the amount of money corporations can invest in political spending. This came after a ruling by the Supreme Court (Citizens United vs. Federal Election Commission) advising that congress could not limit corporate spending in political broadcasts for candidate elections because such restrictions would infringe on a corporation's right to free speech. Kerry has strongly objected this ruling stating, "I think we need a constitutional amendment to make it clear once and for all that corporations do not have the same free speech rights as individuals." Traditionally corporate America and unions have opposed such legislation. If you recall, one of the strongest arguments for the tax deductibility of advertising, is a business' first amendment right to free speech. Legislation that puts qualifications on free speech of corporations is a potential danger to companies, media and advertisers alike.
